Can a single parent adopt in Utah if cohabiting?

Utah law does allow a single (unmarried) person to adopt a child. But there are certain limitations and restrictions that can apply.

Under Utah Code 78B-6-117 (2013), a single person is not permitted to adopt a child if that person is cohabiting in a relationship that is not a legally valid marriage under the laws of Utah. The term “cohabiting” is specifically defined for purposes of Utah adoption law as meaning “residing with another person and being involved in a sexual relationship with that person.”  See, Utah Code 78B-6-103(2013). The statutory definition does not make any distinction between same-sex and heterosexual relationships.

Utah adoption law provides other restrictions on single-parent adoptions that create a preference for adoption by married couples in many cases.  But Utah law does allow single parents to adopt a minor child.  A Utah adoption attorney can help you navigate the legal system toward a successful adoption.
